Il decreto legislativo sulle Rinnovabili, approvato già dal Consiglio dei Ministri, è stato validato dal Presidente Napolitano; divengono dunque attuative le nuove regole sulle Energie Rinnovabili e sulla loro integrazione negli edifici nuovi e ristrutturati .
Nella formula finale del Decreto cambiano le scadenze e gli obblighi (Allegato 3 del Decreto); nei centri storici (zone A del DM 1444/1968), The percentages have been reduced to 50%, with the exception of buildings protected by the Code of Cultural Heritage (Part II and Art. 136, paragraph 1, letters b) and c)) and the planning instruments in force, in cases where there is evidence that compliance with the requirements would be incompatible with the historical features and artistic values.
The designer should document in the technical report that it is possible to comply with the obligations, where necessary examining the non-feasibility of all the different technology options available, resulting in an overall building energy performance index (I) less than the total relevant required under Decree No. 192/2005 and subsequent amendments
The non-compliance means non-issuance of the building, for plantations to meet those obligations, access to government incentives for renewable sources only for the portion that exceeds that required for compliance with the provisions of the Decree.
Specifically, Article. 9 provides that, in new buildings and existing buildings undergoing major renovation, the facilities of the heat energy should cover 50% of expected use for hot water and the amount of expected use for hot water, heating and cooling through the use of energy from renewable sources, according to the following percentuali:
a) il 20% se il titolo edilizio è stato richiesto dal 31 maggio 2012 al 31 dicembre 2013;
b) il 35% se il titolo edilizio è stato richiesto dal 1° gennaio 2014 al 31 dicembre 2016;
c) il 50% se il titolo edilizio è stato rilasciato dal 1° gennaio 2017.
