The main associations of the photovoltaic industry, APER (Association of Renewable Energy Producers), Ace Energy Future, Assosolare and GIFI (Italian Photovoltaic Companies Group), launched an appeal to President Napolitano for failing to affix his signature and endorsements for legislative decree transposing Directive 2009/28/EC on the promotion of renewable energy, already approved in the Council of Ministers.
Decree " Ammazzarinnovabili " (as it was renamed) would not be constitutional for excessive delegation, because Parliament has delegated the Government to implement the existing European Directive but the Government has not implemented in any way the opinions parliamentary committees, namely the institution delegating.
Please note that the Legislative Decree transpose Directive 2009/28/EC on the promotion of renewable energy by removing the current ceiling of 8,000 MW for photovoltaics (which was suspended over the provision of incentives). As of 1 June 2011, will start a consultation between the Ministry of Economic Development and the Ministry of Environment in order to create an additional measure to restructure in a manner defined incentives and caps for the various sources of energy.
The decree will define a new system of incentives for plants in operation from 1 January 2013, with differentiation for smaller and larger sized plants, with a twofold objective: to provide certainty to small investors and at the same time, stimulate producers più grandi per raggiungere soluzioni più efficienti. Fondamentalmente, soprattutto per il fotovoltaico, si procederà a ridefinire criteri e parametri per scoraggiare iniziative dettate dalla speculazione e allo stesso tempo garantire una possibilità reale di sviluppo. In particolare, in difesa del paesaggio rurale, e tuttavia trasformando l’energia in un possibile reddito aggiuntivo per gli agricoltori, gli impianti fotovoltaici sui terreni agricoli non potranno superare il limite di 1 MW e non potranno coprire più del 10% del terreno.
